Merch Pocket Terms of Service

These Terms of Service govern your access to and use of the Merch Pocket website, including all content, features, and services offered at https://merchpocket.com (“Merch Pocket,” “we,” or “us”). “You” or “user” refers to anyone using the Site.
Please read these Terms carefully. By creating an account or using the Site, you agree to be bound by these Terms, our Payment Terms, and Privacy Policy. If you do not agree, do not use the Site.

1. Eligibility
Users must be at least 18 years old to use the Site. Users aged 13–17 may use the Site only with parental or guardian permission.
Users under 13 are not permitted to use the Site.
Users must not be subject to trade restrictions or sanctions in India, the U.S., EU, or any other jurisdiction.
By using the Site, you represent that you meet these requirements.
2. Key Terms
Buyers: Users who purchase services on Merch Pocket.
Services / Gigs: Services offered on Merch Pocket.
Service Addons / Gig Addons: Additional services offered on top of the base Service for extra cost.
Gig Packages: Structured formats for services with multiple price points.
Gig Page: Page where Sellers describe their Services and Buyers create Orders.
Order Page: Where Buyers and Sellers communicate about an Order.
Orders: Formal agreements between Buyer and Seller.
Sellers / Freelancers: Users offering services on Merch Pocket.
Seller Page: Page where Sellers showcase their portfolio, services, and professional details.
Logo Design: Original designs uploaded by Sellers for Buyer use.
3. Account Responsibilities
Only registered users may buy and sell on Merch Pocket.
Provide accurate, complete, and updated account information.
Maintain password confidentiality; you are responsible for activity on your account.
Sellers set their own pricing; Merch Pocket may set minimum starting prices in certain categories.
Buyers pay Merch Pocket in advance to create an Order (see Payment Terms).
Users must complete Orders and may not cancel without cause.
4. Orders
Orders are marked as completed when the order is delivered and accepted by the Buyer.
Both Buyers and Sellers may submit disputes during an Order before it is completed.
Sellers must provide the work as described; Buyers must provide required materials or feedback promptly.
Users are responsible for scanning all transferred files for viruses or malware. Merch Pocket is not liable for damages from site usage or file transfers.
Buyers may request revisions through the Order Page if delivered work does not meet agreed requirements.
- Merch Pocket may charge service or processing fees for transactions conducted through the platform. Applicable fees are displayed during checkout or within order details.
5. Sellers
Sellers must deliver services as described on their Gig Page.
Sellers may not promote Merch Pocket content via Google Ads.
Services must be original or properly licensed.
Sellers may offer Service Addons or Gig Packages related to the base Service.
Sellers may use third-party names or trademarks only if necessary to describe services or if licensed.
6. Buyers
Buyers may only use legally obtained funds to place Orders.
You may not bypass Merch Pocket to pay Sellers outside the platform.
Merch Pocket may use delivered work for marketing purposes unless restricted by the Seller.
7. Content Moderation, Reporting, and Appeals
Users must not submit inappropriate content, spam, or abusive communications.
Users may report suspected violations or copyright/trademark issues through our Help Center.
Merch Pocket may remove or restrict accounts, Gigs, or content for violations.
Appeals regarding content moderation, account actions, or disputes may be submitted within six months of notification.
8. Ownership and Licenses
Buyers receive intellectual property rights for delivered work upon full payment.
Sellers retain ownership but grant Buyers rights unless otherwise specified.
Commercial Use Licenses may be purchased via Service Addons.
Merch Pocket may use user-generated content (UGC) for marketing and platform operation.
Sellers guarantee they have sufficient rights or licenses for all services offered.
9. Disclaimers
Services and the Site are provided “as-is.” Merch Pocket does not guarantee specific outcomes or performance quality.
Merch Pocket is not liable for indirect, incidental, or consequential damages.
10. Governing Law
As a company based in India providing services worldwide, these Terms are governed by Indian law.
Users in the U.S. or Canada agree that, to the extent applicable, disputes will be governed by New York State law.
Users elsewhere agree to respect applicable local laws and regulations.
11. Security and Account Deactivation
Users can enable security features to protect accounts.
Accounts may be deactivated voluntarily or by Merch Pocket for violations.
Deactivated accounts remain responsible for any outstanding payments.
12. General Terms
Changes to Terms: Merch Pocket may update Terms; continued use indicates acceptance.
Severability: If a part of the Terms is unenforceable, the rest remains in effect.
Assignment: Merch Pocket may assign rights; users may not assign without consent.
Entire Agreement: These Terms constitute the full agreement regarding the Site and services.
